FOUNDATIONAL PILLAR – Board Governance and Processes


EXPECTATION

The Board expects stakeholders will be provided with a clear, fair and expeditious process when appealing decisions made by the Superintendent or on behalf of the Superintendent.


REQUIREMENTS AND LIMITS

  1. The Board or a committee of the Board will consider reviewing decisions made by the Superintendent, if
    1. the request is made by the stakeholder in writing, and
    2. a majority of the Board agrees to review the decision.

  2. Appeals involving student transportation will be heard by the Transportation Committee. A decision of the Transportation Committee is deemed to be a decision of the Board.
  3. Appeals involving student expulsion will be heard by the Student Appeals Committee. A decision of the Student Appeals Committee is deemed to be a decision of the Board.
  4. If the Board decides to conduct a review of a decision made by the Superintendent, it will do so without undue delay at a Board of Trustees Meeting or at a Special Meeting of the Board.
  5. If the Board decides to review a decision of the Superintendent, prior to the review meeting or at any time after the commencement of the process, the Board may,
    a. request additional information from the stakeholder
    b. request additional information from staff.

  6. Upon review of a decision of the Superintendent the Board may conclude
    1. the Superintendent’s decision is consistent with policy and uphold the decision, or
    2. the Superintendent’s decision is not consistent with policy and uphold the decision, or
    3. the Superintendent’s decision is not consistent with policy and render an alternate decision, or
    4. the Superintendent’s decision is consistent with policy but policy does not adequately address the situation in a manner that is consistent with the Organizational Goals and render an alternate decision.

  7. As soon as is practically possible, the Board will inform the stakeholder of the
    1. decision
    2. rationale supporting the decision
    3. right to appeal the decision to the Minster of Education, if applicable.
